Terms of use

Last updated:

These Terms of Use (“Terms”) govern your access to the Port & Dial website and your submission of private watch sourcing requests. Port & Dial is a Hong Kong-based private watch sourcing studio. These Terms do not by themselves create a purchase contract. Any sourcing engagement or transaction will also be subject to the written quotation, invoice, order confirmation, or other transaction-specific terms accepted by the relevant parties.

Eligibility and acceptable use. You must have legal capacity to enter into a binding agreement and may use the website only for lawful purposes. You must not interfere with the operation or security of the website, attempt unauthorised access, submit false or misleading information, misuse another person’s identity or intellectual property, or use the website in a way that could harm Port & Dial, its network, or other users.

Nature of the sourcing service. A sourcing request is an enquiry and does not guarantee availability, price, condition, delivery timing, or acceptance. Port & Dial may search through independent sources and specialist channels across Asia and elsewhere, but no watch is reserved and no engagement, agency, fiduciary relationship, or obligation to transact arises until confirmed in writing. We may decline or discontinue a request where we cannot identify a suitable option or where legal, compliance, reputational, or practical concerns arise.

Brand status, references, and selection. Unless expressly confirmed in writing for a particular transaction, Port & Dial is an independent sourcing studio and is not an authorised dealer, agent, or representative of any watch brand. Brand names, trademarks, model names, and reference numbers are used only to identify watches. Current Selection content, photographs, descriptions, indications of availability, and prices may change without notice and do not constitute an offer or reservation.

Quotes, fees, deposits, and payment. Watch price, sourcing or service fees, deposit requirements, currency, payment method, payment deadlines, cancellation terms, and refund treatment will be stated in the applicable written transaction terms. You are responsible for reviewing those terms and providing complete and accurate billing, identity, and delivery information. If these website Terms conflict with transaction-specific terms, the transaction-specific terms will govern that transaction.

Condition, provenance, authenticity, and inspection. Information about a watch may come from third-party sources. Port & Dial will communicate material information reasonably available to it, but pre-owned and vintage watches may show wear, servicing, repairs, refinishing, or replacement parts. Inspection, authentication, condition reporting, or third-party verification may be arranged where agreed. Any express warranty or representation must appear in the applicable written transaction terms. Nothing in these Terms limits rights or remedies that cannot lawfully be excluded.

Shipping, insurance, import, and taxes. The delivery method, insurance, allocation of shipping costs, transfer of title and risk, customs documentation, import duties, taxes, and other charges will be confirmed in the applicable written transaction terms. You are responsible for providing accurate delivery information and for checking whether a watch may lawfully be imported into or possessed in the destination jurisdiction, except to the extent responsibility cannot be excluded under applicable law.

Cancellations and returns. Cancellation, exchange, and return rights depend on the transaction, the source of the watch, work already performed, costs already incurred, and mandatory law. The applicable terms will be provided before payment or commitment. Do not send any watch, payment, or other property to Port & Dial unless written instructions have been provided and confirmed.

Website content, intellectual property, and third-party services. The website and its original content, design, logos, and graphics are owned by or licensed to Port & Dial and may not be copied, republished, or commercially exploited without permission. When you send photographs, documents, or other material, you confirm that you are entitled to provide them and grant Port & Dial a limited right to use them only to assess, communicate about, and fulfil your request or meet legal obligations. Third-party links and services are provided for convenience; Port & Dial does not control their content or practices.

Disclaimers, liability, changes, and governing law. The website is provided on an “as available” basis. To the extent permitted by law, Port & Dial does not guarantee that website content will always be complete, current, uninterrupted, or error-free, and is not responsible for indirect or consequential loss arising solely from website use. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded. We may revise these Terms for future use of the website, with the latest revision date shown on this page. These Terms are governed by the laws of the Hong Kong Special Administrative Region, and its courts will have non-exclusive jurisdiction, subject to any mandatory protections that apply in your place of residence. Questions may be submitted through the Private Sourcing page.
